Inmate Hospitalized After Scuffle With Officers

JACKSONVILLE, FL -- A Duval County Jail inmate is at Shands Jacksonville being treated for breathing difficulties following a violent altercation with corrections officers early Tuesday morning.
Police are quick to point out the inmate, John Gregory Laughon, was transported to the hospital not for treatment of injuries, but for his mentally violent state.
According to Jacksonville Sheriff's Office Chief Steven Weintraub, Laughon was originally arrested last November on a marijuana charge. On January 25, 2005, he was sentenced to serve 6 months in jail on those charges.
Police went on to explain that, this week, Laughon was being treated by the mental health team at the jail.
According to police reports, on Sunday, February 20, 2005, police arrested Laughon again, alleging that he assaulted a corrections officer with his fists. At that time, he was pepper-sprayed by two separate officers.
Late Monday night, corrections officers responded to Laughon's cell where he was reportedly banging on the glass, cursing and spitting at officers through the food flap. As an officer opened the cell door, Laughon allegedly punched the officer in the face. He was booked once again on another battery charge.
About four hours later, just before 3 a.m. Tuesday, officers went to the isolation cell where Laughon was being restrained. The inmate was placed in a restraint chair, but according to police reports he had somehow freed himself and was sitting on a bench.
The police report says, "As the officer looked into room, the inmate immediately charged the door. Before the officer could react, he was violently struck by the door and thrown against the wall to land of the floor." It goes on to say, "A second officer attempted to exit the jail control booth but was immediately charged by Laughon forcing her back into the booth. The inmate violently attacked her and shoved her against the cell wall. He cornered her against the wall and forced her to the floor with violent strikes with his fists about her body and head area."
Police tell First Coast News more officers then responded. They say it took four officers to restrain Laughon.
Two corrections officers went to Shands for treatment of possible broken bones.
Laughon was placed in full restraints and transported to Shands for treatment of minor injuries because of his mental state.
Once at the hospital Laughon was placed in a secure waiting room by a security guard and a JSO officer. A short while later he began to have breathing difficulties and was rushed in for treatment.
Right now there is no word on Laughon's condition. The JSO Homicide 'Use of Force Team' was called in to investigate at both the jail and the hospital.

First, I have to correct Weintraub in saying John Laughon was sentanced on January 25, 2005. He turned himself in to serve his 6 months on January 25, 2005. His trial was in 2004, he was sentanced then and was given time to work and put money in the bank to pay his bills while he served his 6 months for possession. He was so little of a threat to public safety they allowed him time to get his affairs in order being going to serve his time.
John was not having difficulty breathing when he arrvied at Shands, the witness we met said she didn't notice if he was breathing when he was taken out of the sheriff's van hog tied with shackles behind his back. If they thought he was having difficulty breathing why didn't they call an ambulance or life flight? Was he beaten to a pulp in the jail or somewhere along the way? Then they go on to say he was taken to Shands " not for treatment of injuries, but for his mentally violent state." Okay, so which is it? Was he having difficulty breathing or was he taken because of his mental state? He has not received treatment for any mental condition at Shands to this day.
They admit to two officers using "pepper spray" on John. They go on to claim John "was placed in a restraint chair, but according to police reports he had somehow freed himself and was sitting on a bench." I guess he was a magician then. I have seen an article about a football player who was restrained in this chair by JSO and he did not free himself.

Here we go again, was he transported because he had minor injuries, was he having difficulty breathing, or for his mental state? He was not "rushed" in for treatment, a nurse who was passing by notice he was not brathing and started CPR.
The article says that police reports say about one of the guards: "The inmate violently attacked her and shoved her against the cell wall. He cornered her against the wall and forced her to the floor with violent strikes with his fists about her body and head area." You will see in other articles to use the word "pummel." To pummel someone is to "beat" them. You will see that the guard they claim was pummelled only got a scratch behind their ear. If a person were coherent and pummelled someone, the person being pummelled would have more then a scratch. This goes to support that John was having seizures and was not coherent. John has never hit a female in his life on purpose. I should know I am his sister. He has had seizures in my home and did not harm myself, my husband nor my daughter, who was about 3 years old at the time.
John's condition was known at the time of this report but they did not want the public to know he had 11 broken ribs, both lungs collasped, injuries from head to toe and was on life support since that would not support their claim he only had minor injuries or he was only taken to Shands for his mental condition.
If they needed to restrain John, why didn't they use an "extraction team" and video tape it? After all, that is procedure. The subject of video tape will come up later also.

Inmate’s family blames condition for outburst

At last check, Laughon was in critical condition.Inmate John Laughon was hospitalized on Tuesday following a jailhouse scuffle with four corrections officers.
According to police, Laughon showed super human strength as he fought with officers at the jail. Now, Laughon’s family is speaking out with a different side of the story.
"I'm upset because they seem like they're trying to cover something up,” says Antonio Seara, Laughon’s brother. “That's why I'm talking."
Authorities say several correction officers had to physically restrain the 37-year-old inmate after he became violent. They also say that Laughon broke out of a restraint chair and began to struggle, showing no signs of letting up.
"I don't believe he's powerful enough to break out. He's not a super human like they're trying to say," says Seara.
According to Seara, Laughon is not the 6-foot, 185 pound powerhouse that police described. He says his brother-in-law is actually about, 5-foot-5 and around 145 pounds.
However, even before Tuesday's incident, Laughon, who's serving a 6-month sentence for marijuana possession, was also charged with two counts of battering a law enforcement officer.
"He's not that big where four guards can't hold him down without causing that type of injury to him, where at one point he had to be revived," says Seara.
Laughon's family believes he was suffering a seizure at the time he fought with officers in the jail. It’s a problem they say could easily get out of hand, as they've seen, unless he's taken his medication.
"Before he had his medication, he was living with me. We considered it sleep walking. He woke up, bouncing off the walls, swinging," says Seara.
Official investigators say it is not clear if Laughon's current condition is the result of his pre-existing illness or because of his struggle with officers. Laughon’s family also hopes to find out as they hire attorneys to do their own investigation.
Says Seara, "I just want him to come out OK. It doesn't sound so good."

Antonio Seara is John Laughon brother in law, not his brother.
John Laughon is not 6 foot and 185 lbs like JSO claims. He is quite thin maybe 145 lbs and about 5'8" or 5'9". His drivers license says he is 5'9" and his jail records said 5'9" so where did JSO get 6 foot tall from. Seems like they were trying to make him out to be this huge brut of a man but he is not. John had seizures while living in my home and I held him down by MYSELF. I sat across his legs and all he did after that was try to sit up until the seizure stopped. He never hurt anyone in my home when having a seizure which leads us to beleive that the guards were the agressors.
John Laughon's seizures are a matter of court record and documentation was provided to the court during his trail because in November on the night he was taken in for arraignment, he was not given his seizure medication, that mom provided law enforcement officers with as they left the house with John and he had a seizure then and guards jumped on him. John told his family all he remembers was hearing the nurse tell the guards "get off of him, he is having a seizure" and telling doctors at Shands his neurologist worked in this hospital.

JACKSONVILLE, FL -- Last Tuesday, 37-year old John Laughon was taken to the hospital after a fight with corrections officers. Three officers also received medical attention.
The police report says Laughon was in a restraining chair in an isolation cell for a previous assault on an officer.
During a routine check, Officer Christopher Kelsey found Laughon out of his restraints.
Police say Laughon lunged at Kelsey and threw him against the wall.
Officer Kelsey received minor internal bruising.
Officer Christy Sames says Laughon "violently attacked her and shoved her against the wall... The inmate forced her to the floor with violent strikes with his fists about her body and head... The inmate relentlessly pummeled her with his strikes."
The police report says Officer Sames was treated for a minor scratch behind her left ear.
Kelsey and Sames are back at work, but were unavailable for comment.
A third injured officer, Richard Shinhosler, tells First Coast News he has a broken finger, but is also back at work.
Laughon remains unconscious at Shands Hospital.
The family took pictures last Thursday that show Laughon bruised and in a neck brace.
JSO Chief Steve Weintraub told reporters last Tuesday Laughon had no visible injuries, but was taken to the hospital for his mental health.
Chief Weintraub said Laughon was suffering from excited delirium, and possessing "super human strength."
Laughon's brother-in-law, Tony Seara, says Laughon doesn't suffer from excited delirium, but rather seizures.
"I think that's what happened," said Seara. "He was having a seizure, and officers just went off on him and attacked him"
"When John has seizures, he moves his arms all around," said Seara.
Laughon's family is working with an attorney.

Did JSO Chief Steve Weintraub see John when he left the jaiL? Did he see John when he arrived at the hospital? Did he see John after hospital did CPR to start his heart again? I doubt it. If he had he would have known that John had VISIBLE INJURIES and was not "taken to the hospital for his mental health." I provided the picture above to the media, it was taken less then 48 hours of John's arrival at Shands hospital. I cannot take credit for taking the picture.
In a previous article JSO claimed 2 officers/guards went to the hospital, now they claim 3 received treatment for injuries. This also says the officer had a broken finger not hand, like I mentioned before.
Here we go with the pummeled version, "The inmate relentlessly pummeled her with his strikes." As I mentioned before, to pummel is to "BEAT." The very next statement says, "The police report says Officer Sames was treated for a minor scratch behind her left ear." If Sames was actually pummelled by a coherent person she would have received more then a scratch behind the ear. If anyone was "pummelled," it was John, he had injuries like a person who was "pummelled" when he arrived at Shands. His injuries were so bad medical stuff felt he needed a neck brace. He was on life support when we first saw him which meant medical staff felt it was necessary to sustain him. Thank God he was basically healthy other then his seizures because I doubt they would have been able to revive him otherwise. He was strong enough to breath with assistance of the machine even though he had two collapsed lungs, not needing to totally rely on the machine. That was one of he first things I noticed after the obivous visible injuries from head to toe, literally. Yes, he had bruises on his toes also. No one should ever have to walk into a trauma unit and see a loved one in that condition, especially when he is in the custody of LAW ENFORCEMENT.
My husband, Tony Seara, speaks for the whole family when he says, "I think that's what happened," said Seara. "He was having a seizure, and officers just went off on him and attacked him."

JACKSONVILLE, FL -- First Coast News is looking into why the Jacksonville Sheriff's Office is trying to keep a First Coast mother from talking.
Ginger Laughon claims her son was beaten into a vegetative state while in the custody of correctional officers in February 2005.
Now, JSO and the City are asking for a gag order, arguing they may not get a fair trial.
Pictures family members say they took of John Laughon in the hospital after a struggle with officers show the 37-year-old with several bruises.
The family attorney told First Coast News that Laughon had broken ribs, collapsed lungs, and bleeding in the brain and chest cavity.
Laughon was serving a six month sentence on drug charges.
His mom says he is now in a persistent vegetative state that could last his lifetime.
Laughon is now on a hospital bed at his mother's house.
"I don't know if he's going to be better," Ginger Laughon told First Coast News earlier this year. "They've really taken his whole life away from him. He can't do anything."
She claims her son was assaulted by officers.
Documents from Shands Hospital show the Emergency Room doctor checked the box for "assault."
Last year, JSO made a statement, saying Laughon left the jail with minor injuries.
"There were no outward signs of visible injuries requiring medical attention, but he was transported to Shands because of his mental health condition," said JSO Chief Steve Weintraub in February 2005.
Since that time, Ginger Laughon and her attorney, Sean Cronin, have been outspoken.
First Coast News has obtained a motion, filed on behalf of JSO and the City of Jacksonville, requesting a gag order on Ginger Laughon and Sean Cronin.
The motion claims "the fairness of the trial is seriously threatened."
Howard Maltz represents the City and JSO.
Maltz would not comment on the motion on camera, saying it defeats the purpose of filing a motion for a gag order.
Maltz did say on the phone that "it's inappropriate for certain lawyers to be trying a case in the media."
Maltz would not elaborate.

JACKSONVILLE, FL -- Genevieve Miller says a JSO Corrections officer beat her during booking last March after she was arrested for marijuana possession. Miller's mug shot shows two black eyes and a broken nose.
Miller says after the beating, she was put in a restraining chair. "The officers, they would walk by and laugh at me, they would point at me, point at their nose and laugh, they would raise their fist at me, and I just had to sit there," said Miller.
Miller's police report shows she wasn't resisting arrest. She filed a report with Internal Affairs, but the corrections officer was exonerated of any charges.
Genevieve isn't the only person who has claimed abuse. 50,000 people are arrested every year in Jacksonville, but the Chief of the Jail says less than one percent require the use of force.
"When physical resistance is offered to a lawful command, that's the rule we use for using force," said Tara Wildes.
Wildes says officers can also use force as self-defense. But sometimes more force than necessary is used.
Former Corrections Officer Edward Mincey was indicted in January on charges he kicked an inmate in the head.
In December, federal investigations were launched into the deaths of two men in JSO custody.
Just this week, another inmate, John Laughon, was taken to the hospital after a struggle with officers.
Police say he's mentally ill, but Laughon's brother in law, Tony Seara, says he was having a seizure. "There's reports that he's this huge man with superhuman strength, that he attacked these guards and that's why he's in the hospital," said Seara. "He's not that big of a person - maybe 145 pounds."
Laughon has cracked ribs, and a collapsed lung. He remain unconscious at the hospital.
There are video cameras in the jail, but they are used as monitoring devices, and do not record activities.
Wildes says the number of times force is used has steadily dropped since 1996, even though the number of inmates has increased.
Wildes also says corrections officers are required to attend in-service training on interpersonal skills.

This incident involved 2 female officer/guards. Of course the guard who hit Miller was not punished.
The report states she was not resisting arrest and it also says "Miller says after the beating, she was put in a restraining chair. They MENTALLY ABUSED her. Her alledged crime? POSSESSION! They must hate marijuana smokers in Jacksonville, Florida. I wonder what will happen when they legalize marijuana. We all know it's a matter of time. Did you know marijuana can help with SEIZURES?
In this article they discus cameras in the jails saying, "There are video cameras in the jail, but they are used as monitoring devices, and do not record activities." I came across another article saying they used the video tapes as evidence against an inmate. I will post it when I find it again. I guess they only tape when it suits their needs. God forbid they could prove one or more of their own were abusing inmates.

Details JSO Forgot to Mention
They never mentioned John was getting his paperwork processed for work release and would have been on work release within a few days of the incident if he had not been hospitalized for injuries he sustain from the beating. He was "PUMMULLED!"
They didn't mention when he arrived at Shands he only had on a pair of boxers, the leg to his inmate uniform and a blood soaked spit mask.
They didn't mention his seizures were a matter of court record, that he called my mom comlaining he did NOT get his medications in jail, he had other inmates call my mom about his medications, he had been locked in a cell without water and was getting water through the food slot in an old potato chip bag from other inmates or that my mom personally delivered one medication they did not have on hand in the jail for his seizures.
They didn't mention that in November 2004 when John went in for arraignment he was denied his seizure medications which my mother provided DEA officers with, the gaurds jumped on himthat night, the nurse told them to get off of John that it's a seizure and he went to Shands then also.
They didn't mention his injuries on February 22, 2005, were life treatening and he had 11 broken ribs in his back, both lungs collasped, laceration on his liver and bruises from head to toe. They were outward signs of injuries and you could tell his injuries were life threatening because he was spitting up blood.

Cameron County District Attorney Armando Villalobos, under indictment for racketeering and other crimes, has been spared a call for his resignation by the county Commissioners Court.
A motion asking him to voluntarily step down failed on a 2-2 vote at a meeting Thursday morning.
The action would not have had any legal bearing if approved, county legal counsel said.

The letter asked [Texas Department of Insurance Commissioner Eleanor] Kitzman to confirm that the association would come up about $10.7 billion short if a storm of that magnitude should strike and what the commission is planning to do about it.
Kitzman confirmed the cash shortfall, based on the damage estimate.

Longoria, 52, of San Benito, appeared Tuesday before U.S. District Judge Andrew S. Hanen, who handed down the sentence. His prison term will be followed by three years of supervised release.

Texas A & M favors campus students
Texas A&M System Chancellor John Sharp and Board of Regents Chair Richard Box have yet to explain why tuition was held flat at the flagship College Station campus while allowed to rise at nine of the System’s 10 other campuses.Rick Perry loves his cronies, hates real people.
But a curious trend occurred, as the situation with tuition was the same at the University of Texas System: Designated undergraduate tuition also was allowed to rise at all of the UT System’s schools, aside from the flagship Austin campus. Tuition at the systems was decided in board meetings a day apart last month.
Critics say regents, all of whom have now been appointed by Gov. Rick Perry, made decisions about tuition based on politics and not sound policy: They held tuition flat at the flagship campuses to send a political message about affordability at the state’s only two public tier-one research universities, but failed to recognize the universities’ unique missions.

The Republican incumbent for the House District 43 seat has raised almost 10 times more money than his nearest challenger, according to candidates' 8-Day fundraising disclosures due May 21.
State Rep. J.M. Lozano, R-Kingsville, reported almost $170,000 in cash and in-kind contributions between April 21 and May 20, including $31,000 in mail advertising from the Hispanic Republicans of Texas and a $65,000 donation from Texans for Lawsuit Reform PAC.
Lozano said the donation from Texans for Lawsuit Reform came in response to about $11,000 in direct mail and consulting fees paid in support of both architect Bill T. Wilson II's and Republican Willie Vaden's campaigns by Valley PAC, a political action committee itself funded in part by Texans for Insurance Reform.

Ok to fire Edcouch-Elsa school board Superintendent
Texas Education Commissioner Robert Scott sided with the Edcouch-Elsa school board’s decision to fire Superintendent Delfino Alemán last year after he made “disparaging” remarks about trustees to local media.
In an order issued last week, Scott denied Alemán’s appeal of his termination and agreed with an independent hearing examiner who partially blamed the superintendent for a breakdown in relations with his bosses.
Kudos to El Paso Mayor John Cook
El Paso Mayor John Cook has made the short list to be recognized as the best mayor in the world.
Cook is one of six mayors in North America and one of 25 worldwide in contention to be named the 2012 World Mayor, to be awarded in December.
Cook was unaware earlier this year that several people had nominated him for the prize.
The award is given by the London-based City Mayors Foundation, an international think tank "to promote strong and prosperous cities as well as good local government," the organization's website says. "Established in 2003, City Mayors encourages city leaders from across the world to develop innovative and sustainable solutions to long-standing urban problems such as housing, transport, education and employment."

The Valley is turning out to vote
Some 37,000 Hidalgo County voters have cast ballots through the first two weeks of early voting, a sum that tops most previous elections with polls still open Friday. While South Texas voters historically vote in big numbers during early voting, Hidalgo County’s 11.9 percent turnout is more than double the state average thus far.Less than 12% is a lot? And if the Rio Grande Valley exceeds state turnout in elections this year, it will be in part due to the efforts of AACT Now phone bankers like Kathy Kennedy who have volunteered some nights to encourage people to vote.
